Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, digital products and consulting services provided by More Than Mobiles Limited ("More Than Mobiles", "we", "us" or "our"). By using our website, purchasing a product, or engaging our services, you agree to these Terms. If you are entering into them on behalf of a company, you confirm you are authorised to do so.

1. Definitions

  • Digital products means templates, toolkits, models, playbooks, guides and similar downloadable or access-based items we sell.
  • Services means the consulting and business support engagements we provide, including sprints, projects and retainers.
  • Order means your purchase of a digital product or your acceptance of a proposal for services.

2. Our website

We provide this website for general information about our products and services. We work to keep it accurate and available, but we do not guarantee it will be error free or uninterrupted, and we may update or change content at any time. Prices shown are in US dollars and are current at the time of publication.

3. Digital products and licence

When you buy a digital product, we grant you a non-exclusive, non-transferable licence to use it for your own business or personal purposes. Unless we agree otherwise in writing, you may not resell, redistribute, sublicense or publish the product, or present it as your own for resale. We retain all intellectual property rights in our products.

4. Services

Services are delivered under the scope set out in the proposal or order confirmation we agree with you. That document, together with these Terms, forms our agreement. Fixed-fee engagements cover the deliverables stated; work beyond that scope is quoted separately before it begins. Retainers continue monthly until either party ends them in line with the notice agreed in the proposal.

5. Payment

Digital products are paid in full at the time of order. For services, we typically invoice a deposit before work starts and the balance on the schedule set in your proposal. Retainers are billed monthly in advance. Invoices are payable by the date shown on them. We may pause work on overdue accounts after giving you notice.

6. Refunds

Refunds are handled under our Refunds and Returns Policy, which forms part of these Terms.

7. Your responsibilities

To do our best work, we rely on you to provide accurate information, timely access to the people and systems we need, and reasonably prompt feedback. Delays in these may affect timelines and, in some cases, cost. You are responsible for how you use our products and recommendations within your business.

8. Intellectual property

We retain ownership of our pre-existing materials, methods and templates. On full payment for a services engagement, you own the specific deliverables we create for you, except for any of our underlying tools, frameworks or third-party components, which remain licensed rather than transferred.

9. Confidentiality

Each party will keep the other's non-public business information confidential and use it only to perform the agreement. This does not apply to information that is public, already known, or required to be disclosed by law.

10. Disclaimers

Our products and services are provided with reasonable skill and care, but business outcomes depend on many factors outside our control. We do not guarantee specific financial, sales or growth results. Our products and advice do not constitute legal, accounting, tax or investment advice, and you should seek qualified professional advice for those matters.

11. Limitation of liability

To the fullest extent permitted by law, our total liability arising from or connected to your order is limited to the amount you paid us for the product or engagement giving rise to the claim. We are not liable for indirect or consequential losses, including lost profits, revenue or data. Nothing in these Terms limits liability that cannot be limited by law.

12. Termination

Either party may end a services engagement as set out in the proposal, or immediately if the other materially breaches these Terms and does not fix it within a reasonable time. Fees for work properly performed up to termination remain payable.

13. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction over any dispute, subject to any right to pursue informal resolution first.

14. Changes

We may update these Terms from time to time. The version in force is the one published on this page when you place your order.
